GENERAL TERMS AND CONDITIONS

Prices are intended EX-WORKS (EXW), net of transport, port and insurance costs. Prices do not include any V.A.T.

Prices for our goods may change from time to time, but changes will not affect any order which we have confirmed.

It is always possible that, despite our reasonable efforts, some of the products on the website may be incorrectly priced. If we discover an error in the price of the products, you have ordered we will inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing.

The delivery dates are always intended as “indicative” and the agreement shall remain fully and unconditionally effective whatever the actual delivery date. In no case shall failure to respect the quoted delivery date give rise to any right to compensation.

We offer the below delivery option:

• Free Pick-up in store (DY98, Shed B, Al Jaddaf, Dubai, UAE )

Within the territory of UAE, shipments of in-stock items will generally be ready for pick-up within 24 hours after receipt of payment. Should the customer choose courier e.g. DHL he shall solely follow up with them for collection at it’s own risk and  expense.

Keeping in compliance with the laws of the United Arab Emirates, GYMS will not sell to any country which is currently under sanctions by the government.

G Y Marine Services LLC shall proceed with the delivery in-store. All transport, including is at the BUYER’s risk. The VENDOR will  not  insure the goods  in case of  shipment, it’s the Buyer’s obligation  and at it’ s own expense .It is the BUYER’s responsibility to check the condition and nature of the goods on arrival. Any loss or breakage found must be notified to the carrier. Any materials not collected within 30 days after notification to BUYER that the order is ready to be shipped/ collected shall be returned to stock and are subject to 10% restocking charges.

Goods which need to be returned ( defected items if any ) will only be accepted subject to prior agreement in writing from G Y Marine Services LLC and if returned from outside the United Arab Emirates must arrive free of any duties and charges. The maximum period for the return of any goods is (14) Fourteen days from the date of purchase.

Payments can be made by major credit, debit card or via  bank transfer, and the transfer must be received by our bank within a maximum period of (7) seven days of the order being placed.  If we do not receive the transfer your order will be cancelled.  In case of payment by bank transfer all charges are for BUYERS account and must be included with the transfer.

The VENDOR warranties that its products are free from manufacturing defects and flaws in the materials for a period of one year from delivery. In case an extended warranty is required for boat builders this needs to be indicated at time of enquiry and in any case prior to confirmation of order. Certain manufacturers provide longer warranty periods than the standard 1 year and this information will be provided upon request by the BUYER.

Defective parts will be repaired free of charge or, at the sole discretion of the VENDOR, replaced; transport and/or dispatch costs shall always be the responsibility of the BUYER. Any removal or installation costs and/or dry-docking expenses are expressly excluded. This undertaking by the VENDOR excludes all other effects of the guarantee provided for by law.

The G Y Marine Services LLC guarantee is not applicable to replacements or repairs resulting from normal wear of the material, from its defective use, from failure to respect the instructions for use or maintenance, from defects in maintenance or supervision, or from faults deriving from the use of spare parts or materials which do not originate from G Y Marine Services LLC. Furthermore, this guarantee will cease to have effect in the event that the BUYER carries out repairs or modifications himself or has such work carried out by third parties without the written consent of G Y Marine Services LLC.

The VENDOR is relieved of all responsibility for all direct or indirect damage and loss of income, which may result from breakdown or defects in the goods supplied. The VENDOR is expressly exonerated from all responsibility and liability for any accidents or damage to persons or property which may occur as a result usage of the delivered goods. This also applies if the accident or damage results from manufacturing or material defects.

The sales agreement and the general conditions of sale are subject, and hence regulated, by the laws of the United Arab Emirates and any disputes arising will be settled by the courts in the United Arab Emirates.
