However, the revised terms will not affect the orders which have already been placed and acknowledged by <strong>GYMS<\/strong> before the change is made. You are encouraged to review these Terms each time you use the site to keep yourself up to date and to know the changes made.<\/p>\n<p>Any purchase from VENDOR by BUYER implies the BUYER&#8217;s express acceptance of these conditions. Minor customers (under the age of 18) shall not register as a user of the website and shall not transact on or use the website. If we discover an error in the price of the products, you have ordered we will inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order. We will not process your order until we have your instructions. Should the customer choose courier e.g. DHL he shall solely follow up with them for collection at it\u2019s own risk and\u00a0 expense.<\/p>\n<p>Keeping in compliance with the laws of the United Arab Emirates, <strong>GYMS<\/strong> will not sell to any country which is currently under sanctions by the government.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space height=&#8221;40&#8243;][\/vc_column][\/vc_row][vc_row type=&#8221;boxed&#8221;][vc_column width=&#8221;1\/4&#8243; offset=&#8221;vc_col-sm-offset-1&#8243;][vc_column_text]4.<strong> DELIVERY\/RETURNS<\/strong>[\/vc_column_text][vc_empty_space height=&#8221;17px&#8221;][\/vc_column][vc_column width=&#8221;7\/12&#8243;][vc_column_text]<strong>G Y Marine Services LLC<\/strong> shall proceed with the delivery in-store. All transport, including is at the BUYER&#8217;s risk. The VENDOR will \u00a0not \u00a0insure the goods \u00a0in case of \u00a0shipment, it\u2019s the Buyer\u2019s obligation\u00a0 and at it\u2019 s own expense .It is the BUYER&#8217;s responsibility to check the condition and nature of the goods on arrival. Any loss or breakage found must be notified to the carrier. Any materials not collected within 30 days after notification to BUYER that the order is ready to be shipped\/ collected shall be returned to stock and are subject to 10% restocking charges.<\/p>\n<p>Goods which need to be returned ( defected items if any ) will only be accepted subject to prior agreement in writing from <strong>G Y Marine Services LLC <\/strong>and if returned from outside the United Arab Emirates must arrive free of any duties and charges. In case an extended warranty is required for boat builders this needs to be indicated at time of enquiry and in any case prior to confirmation of order. Certain manufacturers provide longer warranty periods than the standard 1 year and this information will be provided upon request by the BUYER.<\/p>\n<p>Defective parts will be repaired free of charge or, at the sole discretion of the VENDOR, replaced; transport and\/or dispatch costs shall always be the responsibility of the BUYER. Any removal or installation costs and\/or dry-docking expenses are expressly excluded. This undertaking by the VENDOR excludes all other effects of the guarantee provided for by law.<\/p>\n<p>The <strong>G Y Marine Services LLC<\/strong> guarantee is not applicable to replacements or repairs resulting from normal wear of the material, from its defective use, from failure to respect the instructions for use or maintenance, from defects in maintenance or supervision, or from faults deriving from the use of spare parts or materials which do not originate from <strong>G Y Marine Services LLC<\/strong>. Furthermore, this guarantee will cease to have effect in the event that the BUYER carries out repairs or modifications himself or has such work carried out by third parties without the written consent of <strong>G Y Marine Services LLC.<\/strong>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_empty_space height=&#8221;40&#8243;][\/vc_column][\/vc_row][vc_row type=&#8221;boxed&#8221;][vc_column width=&#8221;1\/4&#8243; offset=&#8221;vc_col-sm-offset-1&#8243;][vc_column_text]7. <strong>THIRD PARTY LIABILITY<\/strong>[\/vc_column_text][vc_empty_space height=&#8221;17px&#8221;][\/vc_column][vc_column width=&#8221;7\/12&#8243;][vc_column_text]The VENDOR is relieved of all responsibility for all direct or indirect damage and loss of income, which may result from breakdown or defects in the goods supplied. The VENDOR is expressly exonerated from all responsibility and liability for any accidents or damage to persons or property which may occur as a result usage of the delivered goods.
